Overview
Home insurance (seguro de hogar) isn't legally required for every household in Spain, but it becomes effectively mandatory in specific situations — and it's worth having even when it isn't required.
Requirements
- If you're buying with a mortgage, Spanish law requires the property to have at least fire insurance for the duration of the loan — lenders commonly require broader home insurance in practice
- If you're renting, home insurance is not legally required, and a landlord cannot force a tenant to take one out unless it's specifically agreed in the contract
Step-by-step process
- If buying with a mortgage, check your lender's minimum insurance requirement before shopping for a policy — you're not obliged to buy through the bank itself
- If renting, decide whether contents insurance makes sense for your own belongings even though it isn't required
- Compare policies covering the three typical components: the building itself (continente), your belongings (contenido), and liability for damage to others (responsabilidad civil)
- Confirm what's excluded — flood, water damage from old plumbing, and specific high-value items often need separate cover
Required documents
- Property deed or rental contract
- Mortgage documentation, if applicable, to confirm the lender's minimum requirement
Common mistakes
- Assuming a landlord's building insurance covers a tenant's own belongings — it generally doesn't
- Buying the bank's bundled insurance without comparing it to the open market, where equivalent cover is often cheaper
- Not checking liability cover, which can matter a lot if, for example, a water leak in your flat damages a neighbour's property
Practical tips
- Even as a tenant with no legal obligation, basic contents and liability cover is inexpensive relative to the protection it offers
- If your mortgage lender requires insurance, you're legally free to buy it from any insurer, not just the bank's own product
