Overview
Once you meet the criteria that make you a Spanish tax resident (see our guide to tax residency), there are specific practical steps to register and start meeting your obligations correctly from day one.
Requirements
- You must already meet one of Spain's tax residency tests (183 days, economic interests, or family ties)
Step-by-step process
- Get your NIF (for tax purposes, this is generally the same as your NIE for foreign residents) if you don't already have one
- Register your address with the Agencia Tributaria, since this determines which regional tax rules apply to part of your income tax
- Notify your home country's tax authority of your change in residency, where required, to avoid being taxed as a resident in two places simultaneously
- Start keeping organised records of all your income — Spanish and foreign — from the point your residency begins, since you'll need this for your first annual return
- File your first annual tax return (Renta) the following spring, covering the full tax year in which you became resident
Required documents
- NIE/NIF
- Empadronamiento certificate
- Records of worldwide income sources
Common mistakes
- Not notifying your home country's tax authority of your change in residency, which can lead to being assessed as a tax resident in two countries for the same period
- Waiting until the annual filing deadline to start organising income records, when a full year's worth of documentation is much easier to gather as you go
Practical tips
- If your home country has a double taxation agreement with Spain, understanding how it applies to your specific income types is worth doing early — see our guide to double taxation agreements
- A gestor or tax adviser experienced with new residents can help you avoid an incorrect first-year filing, which is where most newcomer mistakes happen
